MEMBERSHIP TERMS

MEMBERSHIP TYPES AND PRICING

Under 25 Membership – $25/month
– Available to members under 25 years old
– Valid photo ID required at signup
– 24/7 access to all locations

First Responder Membership – $49/month
– Available to Police Officers, Fire Fighters, EMS, EMT, Active Military & Military Veterans
– Valid service ID required at signup and annually
– 24/7 access to all locations

Single Membership – $69/month
– Individual membership with full facility access
– 24/7 access to all locations

Dual Membership – $99/month
– Two members on one membership
– 24/7 access to all locations

Phoenix Membership – $99/month
– All Single membership benefits
– One (1) guest privilege per visit
– Guest must be accompanied by member at all times

MEMBERSHIP BENEFITS
All memberships include:
– 24/7 access to all Fusion Gyms locations
– Unlimited use of all equipment and facilities
– Access to locker rooms, showers, and saunas
– One complimentary personal training session
– Free Wi-Fi access
– Access to retail supplement shops

NO CONTRACT POLICY
– All memberships are month-to-month with no long-term contracts
– A one-time $10 sign-up fee applies; there are no cancellation fees
– Memberships automatically renew monthly until cancelled

PAYMENT AND BILLING

BILLING TERMS
– Monthly membership fees are charged on the same date each month
– Payment is processed through ABC Fitness payment system
– Accepted payment methods include credit cards, debit cards, and ACH transfers
– All fees are non-refundable except as required by law

LATE PAYMENTS
– Accounts with failed payments will be suspended after 7 days
– A $25 late fee may be applied to accounts with failed payments
– Access to facilities will be restored upon successful payment

CANCELLATION POLICY
– Members may cancel at any time with 30 days written notice
– Cancellation requests must be submitted in writing to any location or via email
– Final billing cycle will occur 30 days after cancellation notice
– No refunds for partial months

FACILITY USAGE RULES

GENERAL CONDUCT
– Members must show valid ID during first visit to each location
– Proper athletic attire and closed-toe shoes required at all times
– Members are responsible for cleaning equipment after use
– Disruptive, threatening, or inappropriate behavior will result in membership termination

EQUIPMENT USAGE
– Equipment must be used as intended and according to posted instructions
– Members must allow others to work in during busy periods
– Time limits may be enforced on cardio equipment during peak hours
– Report damaged or malfunctioning equipment immediately to staff

SPECIALIZED AREAS
– Boxing rings and MMA areas require proper training and supervision
– Basketball courts operate on first-come, first-served basis
– Sauna and cold plunge usage is at member’s own risk
– Outdoor facilities may be closed due to weather conditions

GUEST POLICY (Phoenix Members Only)
– Phoenix members may bring one guest per visit
– Guests must be 18 years or older unless accompanied by parent/guardian
– Guests must sign waiver and follow all facility rules
– Member is responsible for guest’s conduct and any damages

HEALTH AND SAFETY

ASSUMPTION OF RISK
– Exercise and use of fitness equipment involves inherent risks
– Members participate in all activities at their own risk
– Fusion Gyms is not responsible for injuries resulting from proper equipment use
– Members should consult healthcare providers before beginning exercise programs

MEDICAL CONDITIONS
– Members with medical conditions must obtain physician clearance before exercising
– Members must inform staff of any medical conditions that may affect safety
– Emergency medical information should be kept current in member profile

PERSONAL TRAINING
– Complimentary personal training session included with membership
– Additional sessions available for purchase
– Personal trainers are independent contractors
– Members participate in training sessions at their own risk

LIABILITY AND INDEMNIFICATION

LIMITATION OF LIABILITY
– Fusion Gyms’ liability is limited to the maximum extent permitted by law
– We are not liable for indirect, incidental, or consequential damages
– Our total liability shall not exceed the amount paid for membership in the preceding 12 months

MEMBER INDEMNIFICATION
– Members agree to indemnify Fusion Gyms against claims arising from their use of facilities
– This includes claims by guests brought by Phoenix members
– Members are responsible for damages caused by their negligence or misconduct

WAIVER OF CLAIMS
– Members waive claims against Fusion Gyms for injuries or losses
– This waiver applies to all activities and use of facilities
– Waiver extends to Fusion Gyms’ employees, contractors, and agents

PRIVACY AND DATA PROTECTION

INFORMATION COLLECTION
– We collect personal information necessary for membership and facility access
– Payment information is processed securely through third-party processors
– Security cameras operate in common areas for safety and security

INFORMATION USE
– Personal information is used for membership management and communication
– We may send promotional emails with opt-out options
– Information is not sold to third parties

INTELLECTUAL PROPERTY

FUSION GYMS PROPERTY
– All content, logos, and materials are property of Fusion Gyms
– Members may not reproduce or distribute our intellectual property
– Photography or recording in facilities requires written permission

MEMBER CONTENT
– Members grant Fusion Gyms right to use their likeness in promotional materials
– This includes photos, videos, and testimonials taken at facilities
– Members may opt out of promotional use by written request

TERMINATION

TERMINATION BY MEMBER
– Members may terminate membership with 30 days written notice
– Access continues through final billing cycle
– No refunds for unused portions of membership

TERMINATION BY FUSION GYMS
We may terminate memberships immediately for:
– Violation of facility rules or terms
– Threatening or disruptive behavior
– Failure to pay fees after notice
– Fraudulent membership applications

MODIFICATIONS

CHANGES TO TERMS
– Fusion Gyms may modify these terms with 30 days notice
– Notice will be provided via email and posted at facilities
– Continued use of facilities constitutes acceptance of changes

CHANGES TO SERVICES
– We reserve the right to modify facilities, hours, or services
– Reasonable notice will be provided for significant changes
– Temporary closures for maintenance or improvements may occur

DISPUTE RESOLUTION

GOVERNING LAW
– These terms are governed by Pennsylvania state law
– Any disputes will be resolved in courts of Philadelphia County, Pennsylvania

ARBITRATION
– Disputes may be subject to binding arbitration
– Arbitration will be conducted according to American Arbitration Association rules
– Class action lawsuits are waived
